The team at The Barbell Box knows how long and boring terms and conditions can be. However, we want our subscribers to fully understand our policies so that using our subscription box remains a fun, entertaining, and rewarding experience.

Please read these Terms and Conditions ("Terms") carefully before using thebarbellbox.com (the "Site" or "Service") operated by The Barbell Box ("us", "we", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Eligibility

By using this Site and purchasing a Barbell Box Subscription, you represent and warrant that you are at least 18 years of age (or visiting under the supervision of a parent/guardian who agrees to be bound by these Terms on your behalf) and possess the legal authority to enter into a binding contract.

2. Health & Safety Disclaimer (Allergies)

It is the subscriber’s sole responsibility to carefully check the ingredients of each product included in The Barbell Box. You may have allergies or special dietary requirements. The Barbell Box and its partners, directors, and staff cannot and will not be held responsible for any adverse reactions to the products provided. The Service is not designed to provide qualitative medical or nutritional advice.

3. Subscriptions, Billing, and Cancellations

• Initial Billing & Renewals: All new subscriptions are billed immediately upon sign-up. Following the initial charge, your renewal date will be permanently set to the 28th of each month.
• Currency: All pricing is in Canadian Dollars (CAD) and United States Dollars (USD) depending on IP address.
• Cancellation Policy: You may cancel your subscription plan at any time. To avoid future charges, you must cancel at least 48 hours prior to your next scheduled renewal date (the 28th of the month). You can cancel via your user control panel at thebarbellbox.com or by emailing support@thebarbellbox.com.
• No Prorated Refunds: If you cancel your subscription, you will not be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period.

4. Taxes and International Orders

• Canadian Customers: Your total price will include the product price plus any applicable provincial/territorial and local sales tax, based on your shipping address. Your box will ship from our warehouse in the USA. additional taxes, customs, and import duties may apply to your subscription and are your sole responsibility.
• International Customers: Additional taxes, customs, and import duties may apply to your subscription and are your sole responsibility.

5. Purchases and Payments

If you wish to purchase any product or service made available through the Site, you will be asked to supply information relevant to your Purchase including, without limitation, your credit card number, expiration date, billing address, and shipping information.

• You warrant that you have the legal right to use the payment method provided and that the information supplied is true and complete.
• By submitting this information, you grant us the right to provide it to third-party payment processors to facilitate your Purchase.
• We reserve the right to refuse or cancel your order at any time for reasons including product availability, errors in pricing/descriptions, or suspected fraud or unauthorized/illegal transactions.

6. Shipping, Damages, and Refund Policy

Any merchandise purchased from our Site is shipped via a third-party carrier. Title and risk of loss pass to you upon our delivery to the carrier.

• Reporting Damage: All missing or damaged shipments must be reported within 30 days of shipping to qualify for a replacement.
• Process: Damaged item reports must include a photo submitted via our support ticket system. Items will be reviewed by a support agent. Replacements are issued only for damaged products, not for damaged exterior packaging. Minor blemishes to packaging do not qualify as a damaged item.
• Refunds: If a replacement product is available, it will be shipped, and a refund will not be issued. All refunds are issued solely at the discretion of customer support.

7. User Accounts

When you create an account, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms and may result in immediate account termination. You are responsible for safeguarding your password and for all activities under your account. You must notify us immediately of any unauthorized use or security breaches.

8. Intellectual Property

The Service and its original content, features, and functionality are the exclusive property of The Barbell Box and its licensors. The Service is protected by copyright, trademark, and other laws of Canada and foreign countries. Our trademarks may not be used in connection with any product or service without our prior written consent.

9. External Links

Our Site may contain links to third-party websites. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. We provide these links for convenience only, and their inclusion does not imply endorsement. You access them at your own risk.

10. Contests and Promotions

Any contests, sweepstakes, or promotions made available through the Service may be governed by separate rules. If Promotion rules conflict with these Terms, the Promotion rules will apply.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including a breach of the Terms. Upon termination, your right to use the Service will immediately cease. Surviving provisions include ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Limitation of Liability and Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

• The Barbell Box, its directors, employees, and suppliers shall not be liable for any indirect, punitive, special, incidental, or consequential damages (including loss of business, revenue, or data) arising from your use of the Service or its products.
• We do not guarantee that the Service will function uninterrupted, that errors will be corrected.
• In no event will our aggregate liability to you exceed the total amounts paid by you to us.

You agree to defend, indemnify, and hold harmless The Barbell Box and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide notice prior to any new terms taking effect. It is your responsibility to periodically check these Terms. Continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
